Article L214-188 of the French Monetary and Financial Code

A decree shall determine the conditions under which an undertaking or, where applicable, a sub-fund covered by this paragraph shall enter into contracts transferring the insurance risks referred to in article L. 214-187 and the nature of the insurance risks covered by these contracts.

Undertakings or sub-funds covered by this paragraph may sell or unwind contracts transferring the insurance risks mentioned in article L. 214-187 under conditions and within limits defined by decree.

The redemption of units, shares or debt securities issued by an undertaking covered by this paragraph, as well as its obligations under other financing mechanisms to which it has recourse, are subordinated to its commitments under the contracts transferring insurance risks mentioned in article L. 214-187.

Article L214-188

Un décret fixe les conditions dans lesquelles un organisme ou, le cas échéant, un compartiment relevant du présent paragraphe conclut des contrats transférant des risques d’assurance mentionnés à l’article L. 214-187 et la nature des risques d’assurance sur lesquels portent ces contrats.

Les organismes ou compartiments relevant du présent paragraphe peuvent céder ou dénouer les contrats transférant des risques d’assurance mentionnés à l’article L. 214-187 dans des conditions et limites définies par décret.

Le remboursement des parts, actions ou titres de créance émis par un organisme relevant du présent paragraphe ainsi que ses obligations au titre des autres mécanismes de financement auxquels il a recours sont subordonnés à ses engagements au titre des contrats transférant des risques d’assurance mentionnés à l’article L. 214-187.
