Article L2142-6 of the French Labour Code

A company agreement may define the terms and conditions for disseminating trade union information using the digital tools available in the company.

In the absence of an agreement, the trade union organisations present in the company and meeting the criteria of respect for republican values and independence, legally constituted for at least two years, may make publications and leaflets available on a trade union site accessible from the company intranet, where this exists.

The use by trade union organisations of the digital tools made available to them must satisfy all of the following conditions:

1° It must be compatible with the requirements of proper operation and security of the company’s computer network;

2° It must not have consequences that are detrimental to the smooth running of the company;

3° Preserve the freedom of choice of employees to accept or refuse a message.

Un accord d’entreprise peut définir les conditions et les modalités de diffusion des informations syndicales au moyen des outils numériques disponibles dans l’entreprise.

A défaut d’accord, les organisations syndicales présentes dans l’entreprise et satisfaisant aux critères de respect des valeurs républicaines et d’indépendance, légalement constituées depuis au moins deux ans peuvent mettre à disposition des publications et tracts sur un site syndical accessible à partir de l’intranet de l’entreprise, lorsqu’il existe.

L’utilisation par les organisations syndicales des outils numériques mis à leur disposition doit satisfaire l’ensemble des conditions suivantes :

1° Etre compatible avec les exigences de bon fonctionnement et de sécurité du réseau informatique de l’entreprise ;

2° Ne pas avoir des conséquences préjudiciables à la bonne marche de l’entreprise ;

3° Préserver la liberté de choix des salariés d’accepter ou de refuser un message.
