Article L217-1 of the French Consumer Code

I.-The provisions of this chapter apply to contracts for the sale of movable tangible property between a professional seller, or any person presenting or acting as such, and a buyer acting as a consumer.

For the purposes of this Chapter, contracts under which the seller delivers goods and transfers ownership thereof to a consumer and the consumer provides any other benefit, instead of or in addition to the payment of a price, shall be treated as sales contracts.

For the purposes of this Chapter, contracts for the sale of goods to be manufactured or produced shall also be treated as sales contracts.

The provisions of this chapter apply to water, electricity and gas when they are packaged in a delimited volume or in a specific quantity.

The provisions of this chapter shall also apply to goods containing digital elements within the meaning of the introductory article where such elements are supplied with the goods as part of the contract of sale, whether such digital content or digital services are provided by the seller or by a third party. Where it is not clear that the supply of digital content or a digital service is the subject of a separate contract, that supply shall be presumed to fall within the contract for the sale of the goods.

II.-Where a contract brings together the sale of goods covered by this Chapter and other goods not covered by this Chapter, this Chapter applies only to the goods covered by this Chapter. In addition, where a contract has as its principal object the sale of goods covered by this Chapter and, as an ancillary object, the provision of services not covered by this Chapter, this Chapter applies only to the goods. Furthermore, in the case of a bundled offer within the meaning of article L. 224-42-2, the provisions of this chapter only apply to goods.

The conditions for rescinding these contracts are however governed by article L. 217-16.

Article L217-1

I.-Les dispositions du présent chapitre sont applicables aux contrats de vente de biens meubles corporels entre un vendeur professionnel, ou toute personne se présentant ou se comportant comme tel, et un acheteur agissant en qualité de consommateur.

Sont assimilés à des contrats de vente aux fins du présent chapitre, les contrats en vertu desquels le professionnel délivre un bien et en transfère la propriété à un consommateur et ce dernier procure tout autre avantage, au lieu ou en complément du paiement d’un prix.

Sont également assimilés à des contrats de vente aux fins du présent chapitre, les contrats de vente de biens à fabriquer ou à produire.

Les dispositions du présent chapitre s’appliquent à l’eau, à l’électricité et au gaz lorsqu’ils sont conditionnés dans un volume délimité ou en quantité déterminée.

Les dispositions du présent chapitre s’appliquent également aux biens comportant des éléments numériques au sens de l’article liminaire lorsque ces éléments sont fournis avec ces biens dans le cadre du contrat de vente, que ces contenus numériques ou services numériques soient fournis par le vendeur ou par un tiers. Lorsqu’il n’apparaît pas clairement que la fourniture d’un contenu numérique ou d’un service numérique fait l’objet d’un contrat distinct, cette fourniture est présumée relever du contrat de vente du bien.

II.-Lorsqu’un contrat rassemble la vente de biens relevant du présent chapitre et d’autres biens non couverts par le présent chapitre, ce dernier ne s’applique qu’aux biens couverts par le présent chapitre. En outre, lorsqu’un contrat a pour objet principal la vente de biens couverts par le présent chapitre et, à titre accessoire, la fourniture de services non couverts par le présent chapitre, ce dernier ne s’applique qu’aux biens. Par ailleurs, dans le cas d’une offre groupée au sens de l’article L. 224-42-2, les dispositions du présent chapitre ne s’appliquent qu’aux biens.

Les conditions de résolution de ces contrats sont toutefois régies par l’article L. 217-16.
