Article L221-5 of the French Consumer Code

I.-Prior to the conclusion of a contract for the sale of goods or the provision of services, digital content or digital services, the trader shall provide the consumer with the following information in a legible and comprehensible manner:

<1° The essential characteristics of the good, service, digital service or digital content;

2° The price of the good, service, digital service or digital content, pursuant to articles L. 112-1to L. 112-4;

3° The date on which or the period within which the trader undertakes to deliver the goods or provide the service, digital service or digital content;

4° Information relating to his identity, postal, telephone and electronic contact details, cancellation procedures, dispute resolution methods, other contractual terms and conditions and, where applicable, the costs of using the means of distance communication, the existence of codes of good conduct and deposits and financial guarantees;

5° Where applicable, information relating to legal guarantees, functionalities, compatibility and interoperability of the digital content, the digital service or the goods comprising digital elements, other contractual conditions and, where applicable, the existence of any restrictions on software installation;

6° The possibility of recourse to a consumer mediator under the conditions laid down in Title I of Book VI ;

7° Where the right of withdrawal exists, the conditions, timeframe and procedures for exercising this right as well as the standard withdrawal form, the conditions of presentation and details of which are laid down by decree in the Conseil d’Etat ;

8° Where applicable, the fact that the consumer bears the cost of returning the goods in the event of withdrawal and, for distance contracts, the cost of returning the goods where, due to their nature, they cannot normally be returned by post;

9° Information on the consumer’s obligation to pay a fee when exercising his right of withdrawal from a contract for the provision of services, water distribution, gas or electricity supply and subscription to a district heating network, the performance of which he has expressly requested before the end of the withdrawal period; this fee is calculated in accordance with the procedures laid down in Article L. 221-25;

10° Where the right of withdrawal cannot be exercised pursuant to article L. 221-28, information to the effect that the consumer does not benefit from this right or, where applicable, the circumstances in which he loses it;

11° The application of a personalised price on the basis of automated decision-making, where applicable.

The list and content of this information are specified by decree in the Council of State.

In the case of a sale by public auction as defined by the first paragraph of article L. 321-3 of the French Commercial Code, the information relating to the identity and postal, telephone and electronic contact details of the professional provided for in 4° of I of this article may be replaced by those of the authorised representative.

II.In addition to the information provided for in I, any professional, prior to the conclusion of a contract for the provision of services and, where there is no contract, prior to the performance of the provision of services, shall provide the additional information provided for in article L. 111-2.

Article L221-5

I.-Préalablement à la conclusion d’un contrat de vente de biens ou de fourniture de services, de contenu numérique ou de services numériques, le professionnel fournit au consommateur, de manière lisible et compréhensible, les informations suivantes :

1° Les caractéristiques essentielles du bien, du service, du service numérique ou du contenu numérique ;

2° Le prix du bien, du service, du service numérique ou du contenu numérique, en application des articles L. 112-1 à L. 112-4 ;

3° La date à laquelle ou le délai dans lequel le professionnel s’engage à livrer le bien ou à fournir le service, le service numérique ou le contenu numérique ;

4° Les informations relatives à son identité, à ses coordonnées postales, téléphoniques et électroniques, aux modalités de résiliation, aux modes de règlement des litiges, aux autres conditions contractuelles et, le cas échéant, aux coûts de l’utilisation de la technique de communication à distance, à l’existence de codes de bonne conduite et aux cautions et garanties financières ;

5° S’il y a lieu, les informations relatives aux garanties légales, aux fonctionnalités, à la compatibilité et à l’interopérabilité du contenu numérique, du service numérique ou du bien comportant des éléments numériques, aux autres conditions contractuelles et, le cas échéant, à l’existence de toute restriction d’installation de logiciel ;

6° La possibilité de recourir à un médiateur de la consommation dans les conditions prévues au titre Ier du livre VI ;

7° Lorsque le droit de rétractation existe, les conditions, le délai et les modalités d’exercice de ce droit ainsi que le formulaire type de rétractation, dont les conditions de présentation et les mentions qu’il contient sont fixées par décret en Conseil d’Etat ;

8° Le cas échéant, le fait que le consommateur supporte les frais de renvoi du bien en cas de rétractation et, pour les contrats à distance, le coût de renvoi du bien lorsque celui-ci, en raison de sa nature, ne peut normalement être renvoyé par la poste ;

9° L’information sur l’obligation du consommateur de payer des frais lorsqu’il exerce son droit de rétractation d’un contrat de prestation de services, de distribution d’eau, de fourniture de gaz ou d’électricité et d’abonnement à un réseau de chauffage urbain dont il a demandé expressément l’exécution avant la fin du délai de rétractation ; ces frais sont calculés selon les modalités fixées à l’article L. 221-25 ;

10° Lorsque le droit de rétractation ne peut être exercé en application de l’article L. 221-28, l’information selon laquelle le consommateur ne bénéficie pas de ce droit ou, le cas échéant, les circonstances dans lesquelles il le perd ;

11° L’application d’un prix personnalisé sur la base d’une prise de décision automatisée, s’il y a lieu.

La liste et le contenu de ces informations sont précisés par décret en Conseil d’Etat.

Dans le cas d’une vente aux enchères publiques telle que définie par le premier alinéa de l’article L. 321-3 du code de commerce, les informations relatives à l’identité et aux coordonnées postales, téléphoniques et électroniques du professionnel prévues au 4° du I du présent article peuvent être remplacées par celles du mandataire.

II.-Outre les informations prévues au I, tout professionnel, avant la conclusion d’un contrat de fourniture de services et, lorsqu’il n’y a pas de contrat, avant l’exécution de la prestation de services, fournit les informations complémentaires prévues par l’article L. 111-2.
