Article L221-9 of the French Consumer Code

The trader shall provide the consumer with a dated copy of the off-premises contract, on paper signed by the parties or, with the consumer’s agreement, on another durable medium, confirming the express commitment of the parties.

This contract includes all the information set out in article L. 221-5.

Where applicable, the contract shall mention the consumer’s express agreement to the supply of digital content without a physical medium before expiry of the withdrawal period and, in this case, the consumer’s waiver of the right to withdraw.

The contract shall be accompanied by the standard withdrawal form.
The contract is accompanied by the standard withdrawal form referred to in 7° of Article L. 221-5.

Le professionnel fournit au consommateur un exemplaire daté du contrat conclu hors établissement, sur papier signé par les parties ou, avec l’accord du consommateur, sur un autre support durable, confirmant l’engagement exprès des parties.

Ce contrat comprend toutes les informations prévues à l’article L. 221-5.

Le contrat mentionne, le cas échéant, l’accord exprès du consommateur pour la fourniture d’un contenu numérique sans support matériel avant l’expiration du délai de rétractation et, dans cette hypothèse, le renoncement de ce dernier à l’exercice de son droit de rétractation.

Le contrat est accompagné du formulaire type de rétractation mentionné au 7° de l’article L. 221-5.
