In good time and before being bound by a contract, the consumer shall receive information, the list of which shall be laid down by decree in the Conseil d’Etat, covering:
1° The identity and contact details of the professional and of any person acting on his behalf;
2° Information relating to the financial products, instruments and services offered;
3° The right of withdrawal;
4° The contractual terms and conditions, in particular tariffs, and the procedures and place for concluding the contract;
5° The law applicable to the contract and the competent jurisdiction.
The information communicated by the supplier to the consumer on the contractual obligations shall comply with the law applicable to the contract in the event of its conclusion.
This information, the commercial nature of which must be unequivocal, shall be provided in a legible and comprehensible manner by any means appropriate to the means of distance communication used.
This article is applicable without prejudice to the application of legislative and regulatory obligations specific to each product, financial instrument or service offered.
The specific terms and conditions applicable in the event of communication by voice telephony shall be laid down by decree in the Conseil d’Etat.
