A collective agreement may define the method by which negotiations can be conducted in conditions of loyalty and mutual trust between the parties.
This agreement or arrangement specifies the nature of the information shared between the negotiators, particularly at company level, based on the database defined in article L. 2323-8. This convention or agreement defines the main stages in the negotiations and may provide for additional or specific resources, in particular with regard to the number of hours credited to trade union representatives or the procedures for calling on expert advice, in order to ensure that one or more of the planned negotiations runs smoothly.
Unless the agreement stipulates otherwise, failure to comply with its provisions will not render the agreements null and void, provided that the principle of fairness between the parties is respected.
