Article L2222-3-2 of the French Labour Code

An agreement concluded at branch level defines the method applicable to negotiation at company level. This agreement is binding on companies which have not concluded an agreement or convention in application of article L. 2222-3-1. If an agreement mentioned in the same article L. 2222-3-1 is concluded, its stipulations replace the stipulations of this branch agreement.

Unless the agreement provided for in the first paragraph of this article stipulates otherwise, failure to comply with its stipulations shall not render null and void the agreements concluded within the company, provided that the principle of fairness between the parties is respected.

Un accord conclu au niveau de la branche définit la méthode applicable à la négociation au niveau de l’entreprise. Cet accord s’impose aux entreprises n’ayant pas conclu de convention ou d’accord en application de l’article L. 2222-3-1. Si un accord mentionné au même article L. 2222-3-1 est conclu, ses stipulations se substituent aux stipulations de cet accord de branche.


Sauf si l’accord prévu au premier alinéa du présent article en stipule autrement, la méconnaissance de ses stipulations n’est pas de nature à entraîner la nullité des accords conclus dans l’entreprise dès lors qu’est respecté le principe de loyauté entre les parties.
