Article L223-4 of the French Consumer Code

The Minister responsible for the economy shall designate by order the body responsible for managing the telephone cold calling list, after competitive tendering, for a period set by regulation.

The body mentioned in the first paragraph shall make accessible, in an open format that is easily reusable and usable by an automated processing system, the essential data on its activity, in compliance with articles L. 311-5 to L. 311-7 of the code of relations between the public and the administration, and makes public, on its website, an annual activity report including this data.

The operating procedures for the telephone anti-solicitation mechanism, the conditions under which companies have access to an updated version of the list, the procedures for State control of the managing body and the nature of its essential data are determined by decree in the Council of State, issued after a reasoned and published opinion from the Commission nationale de l’informatique et des libertés.

Le ministre chargé de l’économie désigne par arrêté l’organisme chargé de la gestion de la liste d’opposition au démarchage téléphonique, après mise en concurrence, pour une durée fixée par voie réglementaire.

L’organisme mentionné au premier alinéa rend accessible, dans un format ouvert, aisément réutilisable et exploitable par un système de traitement automatisé, les données essentielles de son activité, dans le respect des articles L. 311-5 à L. 311-7 du code des relations entre le public et l’administration, et rend public, sur son site internet, un rapport d’activité annuel comportant ces données.

Les modalités de fonctionnement du mécanisme d’opposition au démarchage téléphonique, les conditions dans lesquelles les entreprises ont accès à une version actualisée de la liste, les modalités du contrôle de l’Etat sur l’organisme gestionnaire et la nature de ses données essentielles sont déterminées par décret en Conseil d’Etat, pris après avis motivé et publié de la Commission nationale de l’informatique et des libertés.
