Article L2232-21 of the French Labour Code

In companies where there is no trade union representative and where the usual number of employees is less than eleven, the employer may propose a draft agreement or an amendment to the employees, covering all the subjects open to collective bargaining in the company as provided for in this code. Employee consultation is organised at the end of a minimum period of fifteen days from the date of communication of the draft agreement to each employee. The conditions of application of these provisions, in particular the procedures for organising staff consultation, are set by decree in the Conseil d’Etat.

Dans les entreprises dépourvues de délégué syndical et dont l’effectif habituel est inférieur à onze salariés, l’employeur peut proposer un projet d’accord ou un avenant de révision aux salariés, qui porte sur l’ensemble des thèmes ouverts à la négociation collective d’entreprise prévus par le présent code. La consultation du personnel est organisée à l’issue d’un délai minimum de quinze jours courant à compter de la communication à chaque salarié du projet d’accord. Les conditions d’application de ces dispositions, en particulier les modalités d’organisation de la consultation du personnel, sont fixées par décret en Conseil d’Etat.
