Article L2232-24 of the French Labour Code

In companies with at least fifty employees, where there are no trade union representatives in the company or establishment, the full members of the staff delegation of the social and economic committee may negotiate, conclude, revise or terminate collective labour agreements if they are expressly authorised to do so by one or more trade union organisations which are representative in the branch to which the company belongs or, failing that, by one or more trade union organisations which are representative at national and inter-professional level. The same organisation may appoint only one employee.

The employer shall inform the representative trade union organisations in the branch to which the company belongs or, failing that, the representative trade union organisations at national and cross-industry level of its decision to enter into negotiations.

The validity of the revision agreements or endorsements concluded in application of this article is subject to their approval by the employees by a majority of the votes cast, under conditions determined by decree and in compliance with the general principles of electoral law.

Dans les entreprises dont l’effectif habituel est au moins égal à cinquante salariés, en l’absence de délégués syndicaux dans l’entreprise ou l’établissement, les membres titulaires de la délégation du personnel du comité social et économique peuvent négocier, conclure, réviser ou dénoncer des accords collectifs de travail s’ils sont expressément mandatés à cet effet par une ou plusieurs organisations syndicales représentatives dans la branche dont relève l’entreprise ou, à défaut, par une ou plusieurs organisations syndicales de salariés représentatives au niveau national et interprofessionnel. Une même organisation ne peut mandater qu’un seul salarié.

Les organisations syndicales représentatives dans la branche dont relève l’entreprise ou, à défaut, les organisations syndicales représentatives au niveau national et interprofessionnel sont informées par l’employeur de sa décision d’engager des négociations.

La validité des accords ou des avenants de révision conclus en application du présent article est subordonnée à leur approbation par les salariés à la majorité des suffrages exprimés, dans des conditions déterminées par décret et dans le respect des principes généraux du droit électoral.
