Article L2232-7 of the French Labour Code

The recognised representativeness of a category-based trade union organisation affiliated to a category-based trade union confederation in respect of the employees it is statutorily entitled to represent gives it the right to negotiate any provision applicable to that category of employees.

Where the branch agreement or professional agreement only concerns a specific professional category covered by an electoral college, its validity is subject to its signature by one or more representative employee trade union organisations having obtained, in the elections taken into account for the measurement of the audience provided for in 3° of article L. 2122-5 or, where applicable, in the elections referred to in article L. 2122-6, at least 30% of the votes cast in this college in favour of organisations recognised as representative at this level, irrespective of the number of voters, and in the absence of opposition from one or more representative employee trade union organisations having obtained in this college a majority of the votes cast in favour of the same organisations at these same elections, irrespective of the number of voters.

La représentativité reconnue à une organisation syndicale catégorielle affiliée à une confédération syndicale catégorielle au titre des salariés qu’elle a statutairement vocation à représenter lui confère le droit de négocier toute disposition applicable à cette catégorie de salariés.

Lorsque la convention de branche ou l’accord professionnel ne concerne qu’une catégorie professionnelle déterminée relevant d’un collège électoral, sa validité est subordonnée à sa signature par une ou plusieurs organisations syndicales de salariés représentatives ayant recueilli, aux élections prises en compte pour la mesure de l’audience prévue au 3° de l’article L. 2122-5 ou, le cas échéant aux élections visées à l’article L. 2122-6, au moins 30 % des suffrages exprimés dans ce collège en faveur d’organisations reconnues représentatives à ce niveau, quel que soit le nombre de votants, et à l’absence d’opposition d’une ou plusieurs organisations syndicales de salariés représentatives ayant recueilli dans ce collège la majorité des suffrages exprimés en faveur des mêmes organisations à ces mêmes élections, quel que soit le nombre de votants.
