Article L2233-1 of the French Public procurement code

In order to enhance the value of a part of the domain, the purchaser may, after having delimited, if necessary, the assets belonging to the public domain, authorise the holder:
1° To grant authorisations to occupy the public domain;
2° To grant private law leases for assets belonging to the private domain and to create all types of property rights for a limited period;
3° To transfer assets that have previously been transferred to him.
The purchaser’s agreement must be expressly stated for each of the authorisations or leases mentioned in 1° and 2° of this article.

Afin de valoriser une partie du domaine, l’acheteur peut, après avoir procédé, s’il y a lieu, à une délimitation des biens appartenant au domaine public, autoriser le titulaire :
1° A consentir des autorisations d’occupation du domaine public ;
2° A consentir des baux de droit privé pour des biens appartenant au domaine privé et à y constituer tous types de droits réels à durée limitée ;
3° A procéder à des cessions pour des biens qui lui ont été préalablement cédés.
L’accord de l’acheteur doit être expressément formulé pour chacune des autorisations ou des baux mentionnés aux 1° et 2° du présent article.
