Article L2253-2 of the French Labour Code

In the following matters, where the branch agreement or the agreement covering a wider territorial or professional field expressly so stipulates, the company agreement concluded subsequent to that agreement or agreement may not contain stipulations different from those applicable to it by virtue of that agreement or agreement, except where the company agreement provides guarantees which are at least equivalent:

1° Prevention of the effects of exposure to the occupational risk factors listed in article L. 4161-1;

2° The professional integration and maintenance in employment of disabled workers;

3° The number of employees above which union representatives may be appointed, their number and the development of their union career;

4° Premiums for dangerous or unhealthy work.

The equivalence of the guarantees mentioned in the first paragraph of this article is assessed for each set of guarantees relating to the same matter.

Dans les matières suivantes, lorsque la convention de branche ou l’accord couvrant un champ territorial ou professionnel plus large le stipule expressément, la convention d’entreprise conclue postérieurement à cette convention ou à cet accord ne peut comporter des stipulations différentes de celles qui lui sont applicables en vertu de cette convention ou de cet accord sauf lorsque la convention d’entreprise assure des garanties au moins équivalentes :

1° La prévention des effets de l’exposition aux facteurs de risques professionnels énumérés à l’article L. 4161-1 ;

2° L’insertion professionnelle et le maintien dans l’emploi des travailleurs handicapés ;

3° L’effectif à partir duquel les délégués syndicaux peuvent être désignés, leur nombre et la valorisation de leurs parcours syndical ;

4° Les primes pour travaux dangereux ou insalubres.

L’équivalence des garanties mentionnée au premier alinéa du présent article s’apprécie par ensemble de garanties se rapportant à la même matière.
