Article L2253-3 of the French Labour Code

In matters other than those mentioned in articles L. 2253-1 and L. 2253-2, the stipulations of the company agreement concluded before or after the date of entry into force of the industry-wide agreement or the agreement covering a wider territorial or professional scope take precedence over those having the same purpose provided for by the industry-wide agreement or the agreement covering a wider territorial or professional scope. In the absence of a company agreement, the branch agreement or the agreement covering a wider territorial or professional scope applies.

Dans les matières autres que celles mentionnées aux articles L. 2253-1 et L. 2253-2, les stipulations de la convention d’entreprise conclue antérieurement ou postérieurement à la date d’entrée en vigueur de la convention de branche ou de l’accord couvrant un champ territorial ou professionnel plus large prévalent sur celles ayant le même objet prévues par la convention de branche ou l’accord couvrant un champ territorial ou professionnel plus large. En l’absence d’accord d’entreprise, la convention de branche ou l’accord couvrant un champ territorial ou professionnel plus large s’applique.
