Article L2253-4 of the French Labour Code

Without prejudice to the provisions of article L. 2253-3, the wage clauses of a company or establishment agreement may provide for specific terms and conditions for the application of wage increases decided by branch agreements or professional or inter-professional agreements applicable in the company.

However, on the one hand, the increase in the total wage bill must be at least equal to the increase that would result from the application of the increases granted by the aforementioned agreements for the employees concerned, and on the other hand, the minimum hierarchical wages must be respected.

Sans préjudice des dispositions de l’article L. 2253-3, les clauses salariales d’une convention ou d’un accord d’entreprise ou d’établissement peuvent prévoir des modalités particulières d’application des majorations de salaires décidées par les conventions de branche ou les accords professionnels ou interprofessionnels applicables dans l’entreprise.

Toutefois, d’une part, l’augmentation de la masse salariale totale doit être au moins égale à l’augmentation qui résulterait de l’application des majorations accordées par les conventions ou accords précités pour les salariés concernés, d’autre part, les salaires minima hiérarchiques doivent être respectés.
