Article L2261-14-3 of the French Labour Code

Whenever a merger, transfer, demerger or any other legal change is envisaged which would have the effect of calling into question an agreement or arrangement, the employers and the trade union organisations representing the employees in the undertakings or establishments concerned may negotiate and conclude an agreement or arrangement replacing the agreements and arrangements called into question and revising the agreements and arrangements applicable in the undertaking or establishment to which the employment contracts are transferred. This agreement will come into force on the date of the event that led to the dispute.

Dès lors qu’est envisagée une fusion, une cession, une scission ou toute autre modification juridique qui aurait pour effet la mise en cause d’une convention ou d’un accord, les employeurs et les organisations syndicales de salariés représentatives dans les entreprises ou établissements concernés peuvent négocier et conclure une convention ou un accord se substituant aux conventions et accords mis en cause et révisant les conventions et accords applicables dans l’entreprise ou l’établissement dans lequel les contrats de travail sont transférés. Cette convention ou cet accord entre en vigueur à la date de réalisation de l’événement ayant entraîné la mise en cause.
