Article L2312-19 of the French Labour Code

A company agreement, concluded under the conditions provided for in the first paragraph of Article L. 2232-12 or, in the absence of a trade union delegate, an agreement between the employer and the Social and Economic Committee, adopted by a majority of the full members of the Committee’s staff delegation, may define:

1° The content, frequency and procedures for the recurring consultations of the Social and Economic Committee referred to in article L. 2312-17 , as well as the list and content of the information required for these consultations;

2° The number of annual committee meetings provided for in Article L. 2315-27, which may not be less than six;

3° The levels at which consultations are carried out and, where appropriate, how they are structured;

4° The deadlines referred to in Article L. 2312-15 within which the committee’s opinions are to be issued.

It may also provide for the social and economic committee to issue a single opinion on all or some of the consultation topics provided for in article L. 2312-17.

The consultation period provided for in the agreement may not exceed three years.

Un accord d’entreprise, conclu dans les conditions prévues au premier alinéa de l’article L. 2232-12 ou, en l’absence de délégué syndical, un accord entre l’employeur et le comité social et économique, adopté à la majorité des membres titulaires de la délégation du personnel du comité, peut définir :

1° Le contenu, la périodicité et les modalités des consultations récurrentes du comité social et économique mentionnées à l’article L. 2312-17 ainsi que la liste et le contenu des informations nécessaires à ces consultations ;

2° Le nombre de réunions annuelles du comité prévues à l’article L. 2315-27, qui ne peut être inférieur à six ;

3° Les niveaux auxquels les consultations sont conduites et, le cas échéant, leur articulation ;

4° Les délais mentionnés à l’article L. 2312-15 dans lesquels les avis du comité sont rendus.

Il peut également prévoir la possibilité pour le comité social et économique d’émettre un avis unique portant sur tout ou partie des thèmes de consultation prévus à l’article L. 2312-17.

La périodicité des consultations prévue par l’accord ne peut être supérieure à trois ans.
