Article L2312-28 of the French Labour Code

In the undertakings and bodies mentioned in the first paragraph of Article L. 2311-1 and in the undertakings mentioned in Article L. 2312-35, the consultation on the company’s social policy, working conditions and employment provided for in 3° of Article L. 2312-17 also covers the company’s social balance sheet when the company has at least three hundred employees. To this end, the employer provides the Social and Economic Committee, under the conditions laid down by the agreement mentioned in article L. 2312-21 or in the absence of an agreement in sub-paragraph 4, with the data relating to this social balance sheet.

In undertakings with separate establishments, the establishment social and economic committee is consulted on the social report specific to each establishment with a workforce of at least three hundred employees.

Dans les entreprises et organismes mentionnés au premier alinéa de l’article L. 2311-1 ainsi que dans les entreprises mentionnées à l’article L. 2312-35, la consultation sur la politique sociale de l’entreprise, les conditions de travail et l’emploi prévue au 3° de l’article L. 2312-17 porte, en outre, sur le bilan social de l’entreprise lorsque l’entreprise compte au moins trois cents salariés. A cette fin, l’employeur met à la disposition du comité social et économique, dans les conditions prévues par l’accord mentionné à l’article L. 2312-21 ou à défaut d’accord au sous-paragraphe 4, les données relatives à ce bilan social.


Dans les entreprises comportant des établissements distincts, le comité social et économique d’établissement est consulté sur le bilan social particulier à chaque établissement dont l’effectif est au moins de trois cents salariés.
