In the undertakings and bodies mentioned in the first paragraph of Article L. 2311-1 and in the undertakings mentioned in Article L. 2312-35, the consultation on the company’s social policy, working conditions and employment provided for in 3° of Article L. 2312-17 also covers the company’s social balance sheet when the company has at least three hundred employees. To this end, the employer provides the Social and Economic Committee, under the conditions laid down by the agreement mentioned in article L. 2312-21 or in the absence of an agreement in sub-paragraph 4, with the data relating to this social balance sheet.
In undertakings with separate establishments, the establishment social and economic committee is consulted on the social report specific to each establishment with a workforce of at least three hundred employees.
