Article L2315-39 of the French Labour Code

The committee is chaired by the employer or his representative.

It comprises at least three employee representatives, including at least one representative of the second college, or where applicable the third college, as provided for in Article L. 2314-11.

The members of the health, safety and working conditions committee are appointed by the social and economic committee from among its members, by a resolution adopted in accordance with the procedures defined in article L. 2315-32, for a term which ends with that of the term of office of the elected members of the committee.

Where the agreement entrusts all or part of the powers of the social and economic committee to the health, safety and working conditions committee, the provisions of article L. 2314-3 apply to meetings of the committee.

The employer may be assisted by members of staff belonging to the company and chosen from outside the committee. Together, they may not exceed the number of full employee representatives.

The provisions of article L. 2315-3 relating to professional secrecy and the obligation of discretion apply to them.

La commission est présidée par l’employeur ou son représentant.

Elle comprend au minimum trois membres représentants du personnel, dont au moins un représentant du second collège, ou le cas échéant du troisième collège prévus à l’article L. 2314-11.

Les membres de la commission santé, sécurité et conditions de travail sont désignés par le comité social et économique parmi ses membres, par une résolution adoptée selon les modalités définies à l’article L. 2315-32, pour une durée qui prend fin avec celle du mandat des membres élus du comité.

Lorsque l’accord confie tout ou partie des attributions du comité social et économique à la commission santé, sécurité et conditions de travail, les dispositions de l’article L. 2314-3 s’appliquent aux réunions de la commission.

L’employeur peut se faire assister par des collaborateurs appartenant à l’entreprise et choisis en dehors du comité. Ensemble, ils ne peuvent pas être en nombre supérieur à celui des représentants du personnel titulaires.

Les dispositions de l’article L. 2315-3 relatives au secret professionnel et à l’obligation de discrétion leur sont applicables.
