Article L2315-42 of the French Labour Code

In the absence of a trade union delegate, an agreement between the employer and the Social and Economic Committee, adopted by a majority of the elected full members of the Committee’s staff delegation, lays down the procedures for setting up the health, safety and working conditions committee(s) referred to in 1° to 6° of Article L. 2315-41.

En l’absence de délégué syndical, un accord entre l’employeur et le comité social et économique, adopté à la majorité des membres titulaires élus de la délégation du personnel du comité, fixe les modalités de mise en place de la ou des commissions santé, sécurité et conditions de travail mentionnées aux 1° à 6° de l’article L. 2315-41.
