Article L2324-3 of the French Public Health Code

When it considers that the physical or mental health or education of children is compromised or threatened:

1° The State representative in the département or the chairman of the département council may issue injunctions to the establishments and services mentioned in the first paragraph of article L. 2324-1;

2° The State representative in the département may issue injunctions to the establishments and services mentioned in paragraphs 2 and 3 of article L. 2324-1.

If the injunctions are not complied with, the representative of the State in the département may order the total or partial, temporary or permanent closure of the establishments or services mentioned in article L. 2324-1, after obtaining the opinion of the president of the département council in the case of the establishments and services mentioned in the first two paragraphs of this article.

Permanent closure constitutes withdrawal of the authorisations instituted in paragraphs 1 and 3 of article L. 2324-1.

In an emergency, the representative of the State in the département may issue a reasoned order for the immediate temporary closure of the establishments mentioned in article L. 2324-1. He shall inform the President of the Departmental Council.

Article L2324-3

Lorsqu’il estime que la santé physique ou mentale ou l’éducation des enfants sont compromises ou menacées :

1° Le représentant de l’Etat dans le département ou le président du conseil départemental peut adresser des injonctions aux établissements et services mentionnés au premier alinéa de l’article L. 2324-1 ;

2° Le représentant de l’Etat dans le département peut adresser des injonctions aux établissements et services mentionnés aux alinéas 2 et 3 de l’article L. 2324-1.

Dans le cas où il n’a pas été satisfait aux injonctions, le représentant de l’Etat dans le département peut prononcer la fermeture totale ou partielle, provisoire ou définitive, des établissements ou services mentionnés à l’article L. 2324-1, après avis du président du conseil départemental en ce qui concerne les établissements et services mentionnés aux deux premiers alinéas de cet article.

La fermeture définitive vaut retrait des autorisations instituées aux alinéas 1 et 3 de l’article L. 2324-1.

En cas d’urgence, le représentant de l’Etat dans le département peut prononcer, par arrêté motivé, la fermeture immédiate, à titre provisoire, des établissements mentionnés à l’article L. 2324-1. Il en informe le président du conseil départemental.
