Article L2326-1 of the French Public Health Code

The following offences are punishable by three months’ imprisonment and a fine of 3,750 euros:

1° Opening or running without authorisation one of the establishments mentioned in article L. 2321-1 or making an inaccurate or incomplete declaration ;

2° Continuing to operate such an establishment despite a closure decision;

3° For those who manage such establishments, obstructing or attempting to obstruct the inspections provided for in article L. 2321-5.

Natural persons guilty of an offence referred to in this article are also liable to the following additional penalties:

1° Temporary or permanent disqualification from holding the position of director of an establishment referred to in article L. 2321-1 ;

2° Temporary or permanent closure of the establishment.

Article L2326-1

Est puni de trois mois d’emprisonnement et de 3750 euros d’amende le fait :

1° D’ouvrir ou de diriger sans autorisation l’un des établissements mentionnés à l’article L. 2321-1 ou de faire une déclaration inexacte ou incomplète ;

2° De continuer l’exploitation d’un tel établissement malgré une décision de fermeture ;

3° Pour ceux qui en assument la direction, de mettre ou de tenter de faire obstacle au contrôle prévu à l’article L. 2321-5.

Les personnes physiques coupables d’une infraction mentionnée au présent article, encourent également les peines complémentaires suivantes :

1° L’interdiction, temporaire ou définitive, d’exercer les fonctions de directeur d’un établissement mentionné à l’article L. 2321-1 ;

2° La fermeture, temporaire ou définitive, de l’établissement.
