Article L2333-5 of the French Labour Code

The Group Works Council shall be set up at the initiative of the dominant undertaking, as soon as the configuration of the group is defined in application of the provisions of this chapter, either following an agreement between the interested parties or, failing this, by a court decision.

This constitution takes place at the latest within six months of the conclusion of this agreement or the intervention of the court decision.

Le comité de groupe est constitué à l’initiative de l’entreprise dominante, dès que la configuration du groupe est définie en application des dispositions du présent chapitre, soit à la suite d’un accord des parties intéressées, soit, à défaut, par une décision de justice.

Cette constitution a lieu au plus tard dans les six mois suivant la conclusion de cet accord ou l’intervention de la décision de justice.
