Article L2363-18 of the French Labour Code

In the case of a European Cooperative Society, the registered office of which is situated in a Member State, the law of which allows, under the conditions provided for in article 4 of article 59 of Council Regulation (EC) n° 1435 / 2003 of 22 July 2003 on the Statute for a European Cooperative Society, the possibility to provide in the articles of association for employees to participate, with voting rights, at the general meeting or at the section or branch meetings, and which is governed by such a system, the managers of the subsidiaries or establishments situated in France organise, in accordance with the procedures applicable in the European Cooperative Society, the procedures for appointing the employee representatives called upon to participate in the meetings of these meetings.

Dans le cas d’une société coopérative européenne dont le siège social est situé dans un Etat membre dont la loi admet, dans les conditions prévues au 4 de l’article 59 du règlement (CE) n° 1435 / 2003 du Conseil du 22 juillet 2003 relatif au statut de la société coopérative européenne, la possibilité de prévoir dans les statuts que les salariés participent, avec droit de vote, à l’assemblée générale ou aux assemblées de section ou de branche, et qui est régie par un tel système, les dirigeants des filiales ou établissements situés en France organisent, selon les modalités applicables dans la société coopérative européenne, les modalités de désignation des représentants des salariés appelés à participer aux réunions de ces assemblées.
