Article L2373-1 of the French Labour Code

A committee of the company resulting from a cross-border operation is set up when, at the end of the negotiation period provided for in Article L. 2352-9, no agreement has been reached and the special negotiation body has not taken the decision provided for in the second paragraph of Article L. 2372-4 or when the managers of the companies participating in the cross-border operation choose, without prior negotiation, to set up employee participation arrangements.

Un comité de la société issue d’une opération transfrontalière est institué lorsque, à l’issue de la période de négociation prévue à l’article L. 2352-9, aucun accord n’a été conclu et que le groupe spécial de négociation n’a pas pris la décision prévue au deuxième alinéa de l’article L. 2372-4 ou lorsque les dirigeants des sociétés participant à l’opération transfrontalière choisissent sans négociation préalable de mettre en place les modalités de participation des salariés.
