Article L2412-1 of the French Labour Code

An employee with one of the following mandates benefits from the protection provided by this chapter in the event of the termination of a fixed-term contract:

1° Trade union delegate ;

2° Elected member of the staff delegation of the social and economic committee;

3° Trade union representative on the social and economic committee;

4° Local representative;

5° Member of the staff delegation of the inter-company social and economic committee;

6° Member of the special negotiating body and member of the European works council;

7° Member of the special negotiation body and representative on the European Company Committee;

7° bis Member of the special negotiation body and representative on the committee of the European Cooperative Society;

7° ter Member of the special negotiating body and representative on the committee of the company resulting from the cross-border merger;

8° Staff representative of an external company, appointed to the health, safety and working conditions committee of an establishment comprising at least one classified facility on the list provided for inArticle L. 515-36 of the Environment Code or mentioned in Article L. 211-2 of the Mining Code;

9° Member of a joint health, safety and working conditions committee in agriculture provided for inarticle L. 717-7 of the rural and maritime fishing code;

10° Employee appointed under the conditions provided for in articles L. 2232-23-1 and L. 2232-26 in companies without a trade union representative;

11° Member of the board or administrator of a social security fund mentioned inarticle L. 231-11 of the Social Security Code;

12° Employee representative in a chamber of agriculture, mentioned inarticle L. 515-1 of the rural and maritime fishing code;

13° Conseiller prud’homme ;

14° Maritime assessor referred to inarticle 7 of the law of 17 December 1926 relating to repression in maritime matters;

15° Défenseur syndical (trade union representative) referred to in article L. 1453-4 ;

16° Member of the commission mentioned in article L. 23-111-1.

Article L2412-1

Bénéficie de la protection en cas de rupture d’un contrat à durée déterminée prévue par le présent chapitre le salarié investi de l’un des mandats suivants :

1° Délégué syndical ;

2° Membre élu de la délégation du personnel du comité social et économique ;

3° Représentant syndical au comité social et économique ;

4° Représentant de proximité ;

5° Membre de la délégation du personnel du comité social et économique interentreprises ;

6° Membre du groupe spécial de négociation et membre du comité d’entreprise européen ;

7° Membre du groupe spécial de négociation et représentant au comité de la société européenne ;

7° bis Membre du groupe spécial de négociation et représentant au comité de la société coopérative européenne ;

7° ter Membre du groupe spécial de négociation et représentant au comité de la société issue de la fusion transfrontalière ;

8° Représentant du personnel d’une entreprise extérieure, désigné à la commission santé, sécurité et conditions de travail d’un établissement comprenant au moins une installation classée figurant sur la liste prévue à l’article L. 515-36 du code de l’environnement ou mentionnée à l’article L. 211-2 du code minier ;

9° Membre d’une commission paritaire d’hygiène, de sécurité et des conditions de travail en agriculture prévue à l’article L. 717-7 du code rural et de la pêche maritime ;

10° Salarié mandaté dans les conditions prévues aux articles L. 2232-23-1 et L. 2232-26 dans les entreprises dépourvues de délégué syndical ;

11° Membre du conseil ou administrateur d’une caisse de sécurité sociale mentionné à l’article L. 231-11 du code de la sécurité sociale ;

12° Représentant des salariés dans une chambre d’agriculture, mentionné à l’article L. 515-1 du code rural et de la pêche maritime ;

13° Conseiller prud’homme ;

14° Assesseur maritime mentionné à l’article 7 de la loi du 17 décembre 1926 relative à la répression en matière maritime ;

15° Défenseur syndical mentionné à l’article L. 1453-4 ;

16° Membre de la commission mentionnée à l’article L. 23-111-1.
