Article L2446-3 of the French Public Health Code

For their application in New Caledonia and French Polynesia :

1° 3° of article L. 2222-2 is replaced by the following provisions:

3° In a place other than a health establishment satisfying the conditions laid down by locally applicable regulations having the same purpose.

2° In article L. 2223-1 and in the first paragraph of article L. 2223-2, the words: “by articles L. 2212-3 to L. 2212-8” are replaced by the words: “by the legislative or regulatory provisions applicable locally”;

3° Article L. 2223-2 is amended as follows

a) In 1°, the words: “mentioned in Article L. 2212-2” are replaced by the words: “health centres authorised by the regulations to carry out voluntary termination of pregnancy”;

b) In 2°, the reference to “the same article L. 2212-2” is replaced by the reference to “1° of this article”.

Pour leur application en Nouvelle-Calédonie et en Polynésie française :

1° Le 3° de l’article L. 2222-2 est remplacé par les dispositions suivantes :

3° Dans un lieu autre qu’un établissement de santé satisfaisant aux conditions prévues par la réglementation applicable localement ayant le même objet.

2° A l’article L. 2223-1 et au premier alinéa de l’article L. 2223-2, les mots : ” par les articles L. 2212-3 à L. 2212-8 ” sont remplacés par les mots : ” par les dispositions législatives ou réglementaires applicables localement ” ;

3° L’article L. 2223-2 est ainsi modifié :

a) Au 1°, les mots : “ mentionnés à l’article L. 2212-2 ” sont remplacés par les mots : “ de santé autorisés par la réglementation à pratiquer des interruptions volontaires de grossesse ” ;

b) Au 2°, la référence : “ au même article L. 2212-2 ” est remplacée par la référence : “ au 1° du présent article ”.
