Article L3000-2 of the French Public procurement code

When a conceding authority concludes a contract intended to satisfy objectively indissociable needs which, on the one hand, come under the ordinary law of concession contracts provided for in Book I of this Part and, on the other hand, come under the special legal regime applicable to other concession contracts provided for in Book II of this Part or the special legal regime applicable to other public contracts provided for in Book V of Part Two, this contract is subject to the provisions applicable to its main purpose.
Where the main purpose of the contract cannot be objectively identified, the contract is subject to the ordinary law governing concession contracts set out in Book I of this Part.

Lorsqu’une autorité concédante conclut un contrat destiné à satisfaire des besoins, objectivement indissociables, qui relèvent, d’une part, du droit commun des contrats de concession prévu au livre Ier de la présente partie et, qui relèvent, d’autre part, du régime juridique particulier applicable aux autres contrats de concessions prévu au livre II de la présente partie ou du régime juridique particulier applicable aux autres marchés publics prévu au livre V de la deuxième partie, ce contrat est soumis aux dispositions applicables à son objet principal.
Lorsque l’objet principal du contrat ne peut être objectivement identifié, le contrat est soumis au droit commun des contrats de concession prévu au livre Ier de la présente partie.
