The provisions of this chapter apply to the following persons:
1° The undertakings carrying on direct insurance business referred to in Article L. 310-1, with the exception of those not covered by the Solvency II regime referred to in Article L. 310-3-2 ;
2° Undertakings referred to in Article L. 310-1-1 carrying on reinsurance business and whose head office is located in France;
3° Insurance group companies referred to in Article L. 322-1-2 ;
4° Entities forming part of an insurance group within the meaning of Article L. 356-1, insofar as they provide services essential to the group’s activities;
5° Mutual insurers and unions governed by Book II of the Mutual Code, with the exception of those not covered by the “Solvency II” regime mentioned in article L. 211-11 of the same code and the group mutualist unions mentioned in article L. 111-4-2 of the same code;
6° The provident institutions and unions governed by Title 3 of Book 9 of the Social Security Code, with the exception of those not covered by the Solvency II regime referred to in Article L. 931-6 of the same code, and the social protection insurance group companies referred to in Article L. 931-2-2 of the same code;
7° The supplementary occupational pension schemes mentioned in Article L. 381-1 of this Code,Article L. 214-1 of the Mutual Code andArticle L. 942-1 of the Social Security Code.
