Article L311-1 of the French Tourism Code

The owner of a building in which a hotel is operated may not, notwithstanding any stipulation to the contrary, object to the execution of works of equipment and improvement that the lessee, the owner of the business, carries out at his own expense and under his own responsibility when such works concern :

1° The supply of water, gas and electricity;

2° Installation of telephone, radio and television receivers;

3° Sanitary equipment;

4° Sewerage;

5° Installation of central heating or distribution of hot or air-conditioned air;

6° Installation of lifts, goods lifts and dumbwaiters;

7° Fitting out kitchens and pantries;

8° The construction of swimming pools,

even if this work entails a change in the layout of the premises.

Where such work affects the shell of the building, it may only be undertaken, in the absence of the owner’s agreement, after a favourable opinion has been given by committees whose composition and operation will be determined by decree adopted on the advice of the Council of State and on which hoteliers and building owners will be represented in equal numbers.

Article L311-1

Le propriétaire d’un immeuble dans lequel est exploité un hôtel ne peut s’opposer, nonobstant toute stipulation contraire, à l’exécution des travaux d’équipement et d’amélioration que le locataire, propriétaire du fonds de commerce, réalise à ses frais et sous sa responsabilité lorsque ces travaux concernent :

1° La distribution de l’eau, du gaz et de l’électricité ;

2° L’installation du téléphone, d’appareils récepteurs de radiodiffusion et de télévision ;

3° L’équipement sanitaire ;

4° Le déversement à l’égout ;

5° L’installation du chauffage central ou de distribution d’air chaud ou climatisé ;

6° L’installation d’ascenseurs, monte-charges et monte-plats ;

7° L’aménagement des cuisines et offices ;

8° La construction de piscines,

même si ces travaux doivent entraîner une modification dans la distribution des lieux.

Dans le cas où ceux-ci affectent le gros oeuvre de l’immeuble, ils ne peuvent être entrepris, à défaut d’accord du propriétaire, qu’après avis favorable de commissions dont la composition et le fonctionnement seront fixés par décret pris sur avis du Conseil d’Etat et dans lesquelles seront représentés en nombre égal les hôteliers et les propriétaires d’immeubles.
