For the duration of the resolution procedure, any asset or liability acquired by the bridge institution may be returned to its original owner, without the latter being able to object, or transferred to a third party.

This new transfer may only be decided by the college of resolution if it was expressly provided for in the initial transfer deed. Article L. 311-24 applies to decisions relating to the retrocessions and transfers provided for in the first paragraph.

The decisions of the collège de résolution relating to the retrocessions and transfers provided for in the first paragraph shall be published in the Journal officiel. This decision releases the bridge institution from all commitments to policyholders, subscribers, participating members, members, employers and subscribing legal entities in respect of the contracts and regulations transferred.

Pendant la durée de la procédure de résolution, tout élément d’actif ou de passif acquis par l’établissement-relais peut être rétrocédé à son propriétaire initial, sans que ce dernier puisse s’y opposer, ou transféré à un tiers.

Ce nouveau transfert ne peut être décidé par le collège de résolution que lorsqu’il a été expressément prévu par l’acte de transfert initial. L’article L. 311-24 s’applique aux décisions relatives à des rétrocessions et des transferts prévus au premier alinéa.

Les décisions du collège de résolution relatives à des rétrocessions et à des transferts prévus au premier alinéa sont publiées au Journal officiel. Cette décision libère l’établissement-relais de tout engagement envers les assurés, souscripteurs, membres participants, adhérents, employeurs, personnes morales souscriptrices, des contrats et règlements transférés.
