Article L3123-22 of the French General Code of Local Authorities

Members of the departmental council may set up an annuity pension in the management of which the affiliated elected representatives must participate.

The constitution of the annuity pension is half the responsibility of the elected member and half the responsibility of the département.

A Conseil d’Etat decree sets the maximum contribution rates.

Les membres du conseil départemental peuvent constituer une retraite par rente à la gestion de laquelle doivent participer les élus affiliés.

La constitution de la retraite par rente incombe pour moitié à l’élu et pour moitié au département.
