At the end of the works concession contract or the contract granting a public service concession, the assets referred to in article L. 3132-4 that have been depreciated during the performance of the concession contract are returned to the assets of the public entity free of charge, subject to the stipulations of the contract allowing the public entity to have the concessionaire take back any assets that are no longer required for the operation of the public service.
The granting to the concessionaire, for the duration of the contract, of ownership of the assets required for the public service other than the works established on the property of a public entity or certain real rights over these assets may not prevent the return of these assets free of charge to the assets of the public entity, subject to the stipulations allowing the public entity to have the assets that are no longer required for the operation of the public service taken back by the concessionaire.
