Article L3142-127 of the French Labour Code

In companies with three hundred or more employees, the employer may defer an employee’s leave or the start of the period of part-time work if exercising this right would result in the percentage of employees simultaneously absent on leave or part-time work being excessive in relation to the total workforce of the company.

Dans les entreprises de trois cents salariés et plus, l’employeur peut différer le départ en congé ou le début de la période de travail à temps partiel du salarié lorsque l’exercice de ce droit aurait pour effet de porter le pourcentage de salariés simultanément absents à ce titre à un niveau excessif au regard de l’effectif total de l’entreprise.
