The employer may defer the start of the leave for up to six months from the date of the request, depending on the proportion of employees absent from the company for the leave or on the number of days of absence planned for the same leave. In companies with fewer than three hundred employees, this limit is increased to nine months.
The employer may also defer this leave on the basis of article L. 3142-114 and, for companies with less than three hundred employees, refuse it on the basis of 1° of article L. 3142-113 in accordance with the terms and conditions set out in the last two paragraphs of the same article L. 3142-113.
