Article L3142-58 of the French Labour Code

In order to implement the employee’s right to the leave referred to in articles L. 3142-54 and L. 3142-54-1, a company collective agreement or, failing that, a branch agreement or convention determines:

1° The maximum total duration of the leave and the conditions for combining it with the economic, social, environmental and trade union training leave provided for in Articles L. 2145-5 to L. 2145-13 ;

2° The time limit within which the employee must send his request for leave to the employer;

3° The rules for determining, per establishment, the maximum number of employees likely to benefit from this leave in the course of a year.

Pour mettre en œuvre le droit à congé du salarié mentionné aux articles L. 3142-54 et L. 3142-54-1, une convention ou un accord collectif d’entreprise ou, à défaut, une convention ou un accord de branche détermine :

1° La durée totale maximale du congé et les conditions de son cumul avec le congé de formation économique, sociale, environnementale et syndicale prévu aux articles L. 2145-5 à L. 2145-13 ;

2° Le délai dans lequel le salarié adresse sa demande de congé à l’employeur ;

3° Les règles selon lesquelles est déterminé, par établissement, le nombre maximal de salariés susceptibles de bénéficier de ce congé au cours d’une année.
