Article L3142-94-3 of the French Labour Code

In the absence of more favourable stipulations resulting from the employment contract, an agreement concluded between the Minister of Defence or the Minister of the Interior and the employer or an agreement mentioned in article L. 3142-94-2, the following provisions apply:

1° The duration of the annual leave of absence is ten working days per calendar year, subject to article L. 3142-89 of this Code andarticle L. 2171-1 of the Defence Code, the second paragraph of article L. 4221-5 of the same Code and articles L. 4231-4 and L. 4231-5 of the said Code ;

2° The notice period within which the employee must inform his employer of his absence or, beyond his annual leave period, send his request to his employer is one month.

A défaut de stipulations plus favorables résultant du contrat de travail, d’une convention conclue entre le ministre de la défense ou le ministre de l’intérieur et l’employeur ou d’une convention ou d’un accord mentionné à l’article L. 3142-94-2, les dispositions suivantes sont applicables :

1° La durée de l’autorisation d’absence annuelle est de dix jours ouvrés par année civile, sous réserve de l’article L. 3142-89 du présent code et de l’article L. 2171-1 du code de la défense, du second alinéa de l’article L. 4221-5 du même code et des articles L. 4231-4 et L. 4231-5 dudit code ;

2° Le délai de préavis dans lequel le salarié prévient son employeur de son absence ou, au-delà de sa durée d’autorisation d’absence annuelle, adresse sa demande à son employeur est d’un mois.
