The Autorité de contrôle prudentiel et de résolution shall ensure that any insurance undertaking referred to in Article L. 310-3-1 which intends to open a branch, to carry on business for the first time under the freedom to provide services in the territory of another Member State of the European Union, or to change the nature or conditions under which such business is carried on, has a system of governance and a financial situation which are appropriate to the business envisaged. The AMF shall also ensure that branches have a general representative who is of sufficiently good repute and has the necessary competence and experience for his duties, which shall be assessed in accordance with the conditions set out in Article L. 322-2.
If the Autorité de contrôle prudentiel et de résolution considers that the conditions referred to in the previous paragraph have been met, it shall provide the supervisory authority of the other Member State with the documents required to carry out the planned activity.
A decree of the Conseil d’Etat shall define the procedures for the application of this article, in particular concerning the notification of the application by the applicant company and the procedures for communication between the Autorité de contrôle prudentiel et de résolution and the other supervisory authorities.
