Article L322-1 of the French Code of civil enforcement procedures

The assets are sold either out of court with judicial authorisation, or by auction.

In the event of an agreement between the debtor, the pursuing creditor, the creditors registered on the seized property on the date of publication of the summons to pay valid as a seizure, the creditors registered on the property before publication of the bill of sale who intervened in the proceedings and the creditor mentioned in 3° of article 2402 of the Civil Code, the property may also be sold by mutual agreement after the compulsory sale has been referred and until the opening of the auction.

Les biens sont vendus soit à l’amiable sur autorisation judiciaire, soit par adjudication.

En cas d’accord entre le débiteur, le créancier poursuivant, les créanciers inscrits sur l’immeuble saisi à la date de la publication du commandement de payer valant saisie, les créanciers inscrits sur l’immeuble avant la publication du titre de vente et qui sont intervenus dans la procédure ainsi que le créancier mentionné au 3° de l’article 2402 du code civil, ils peuvent également être vendus de gré à gré après l’orientation en vente forcée et jusqu’à l’ouverture des enchères.
