Article L3253-18-1 of the French Labour Code

The guarantee institutions referred to in article L. 3253-14 are responsible for settling the outstanding claims of employees who carry out or habitually carried out their activity on French territory, on behalf of an employer whose registered office, in the case of a legal entity, or, in the case of a natural person, the activity or address of the company is located in another Member State of the European Community or the European Economic Area, when this employer is in a state of insolvency.

Les institutions de garantie mentionnées à l’article L. 3253-14 assurent le règlement des créances impayées des salariés qui exercent ou exerçaient habituellement leur activité sur le territoire français, pour le compte d’un employeur dont le siège social, s’il s’agit d’une personne morale, ou, s’il s’agit d’une personne physique, l’activité ou l’adresse de l’entreprise est situé dans un autre Etat membre de la Communauté européenne ou de l’Espace économique européen, lorsque cet employeur se trouve en état d’insolvabilité.
