Article L333-7 of the French Sports Code

The transfer of the right to exploit a sporting event or competition to an electronic public communication service may not prevent other electronic public communication services from informing the public.

The seller or purchaser of this right may not object to the broadcasting by other electronic public communication services of brief extracts taken free of charge from the images of the transferee service(s) and freely chosen by the non-transferee service which broadcasts them.

These extracts are broadcast free of charge during news programmes.

In all cases, their broadcast is accompanied by sufficient identification of the electronic public communication service that holds the right to exploit the event or competition.

The transfer of the right to exploit a sporting event or competition to an electronic public broadcasting service does not prevent the production and free broadcast by any radio broadcasting service, over all or part of the territory, live or deferred, of the oral commentary on this event or competition.

The Autorité de Régulation de la Communication Audiovisuelle et Numérique shall set the conditions for broadcasting the short extracts provided for in this article, after consulting the Comité National Olympique et Sportif Français and the organisers of sporting events mentioned in article L. 331-5.

Article L333-7

La cession du droit d’exploitation d’une manifestation ou d’une compétition sportive à un service de communication au public par voie électronique ne peut faire obstacle à l’information du public par les autres services de communication au public par voie électronique.

Le vendeur ou l’acquéreur de ce droit ne peut s’opposer à la diffusion, par d’autres services de communication au public par voie électronique, de brefs extraits prélevés à titre gratuit parmi les images du ou des services cessionnaires et librement choisis par le service non cessionnaire du droit d’exploitation qui les diffuse.

Ces extraits sont diffusés gratuitement au cours des émissions d’information.

Leur diffusion s’accompagne dans tous les cas d’une identification suffisante du service de communication au public par voie électronique cessionnaire du droit d’exploitation de la manifestation ou de la compétition.

La cession du droit d’exploitation d’une manifestation ou d’une compétition sportive à un service de communication au public par voie électronique ne fait pas obstacle à la réalisation et à la diffusion gratuite par tout service de radiodiffusion sonore, sur tout ou partie du territoire, en direct ou en différé, du commentaire oral de cette manifestation ou de cette compétition.

L’Autorité de régulation de la communication audiovisuelle et numérique fixe les conditions de diffusion des brefs extraits prévus au présent article, après consultation du Comité national olympique et sportif français et des organisateurs de manifestations sportives mentionnés à l’article L. 331-5.
