Article L3332-1 of the French Public Health Code

A 3rd category on-trade public house may not be opened in municipalities where the total number of establishments of this type and 4th category establishments reaches or exceeds the proportion of one public house per 450 inhabitants, or fraction thereof. The population taken as the basis for this estimate is the total municipal population, excluding the population counted separately, as obtained from the most recent census. For tourist municipalities within the meaning of article L. 133-11 of the Tourism Code, the procedures for determining the population taken as the basis for this estimate are determined by decree of the Conseil d’Etat.

However, this prohibition does not apply to establishments that open following a transfer carried out under the conditions set out in article L. 3332-11.

Article L3332-1

Un débit de boissons à consommer sur place de 3e catégorie ne peut être ouvert dans les communes où le total des établissements de cette nature et des établissements de 4e catégorie atteint ou dépasse la proportion d’un débit pour 450 habitants, ou fraction de ce nombre. La population prise pour base de cette estimation est la population municipale totale, non comprise la population comptée à part, telle qu’elle résulte du dernier recensement. Pour les communes touristiques au sens de l’article L. 133-11 du code du tourisme, les modalités de détermination de la population prise pour base de cette estimation sont déterminées par décret en Conseil d’Etat.

Toutefois, cette interdiction ne s’applique pas aux établissements dont l’ouverture intervient à la suite d’un transfert réalisé dans les conditions fixées par l’article L. 3332-11.
