Article L3332-4 of the French Labour Code

Where the company has at least one trade union delegate or a social and economic committee, the company savings plan is negotiated under the conditions set out in article L. 3322-6. If, at the end of the negotiations, no agreement has been reached, a statement of disagreement is drawn up in which the respective proposals of the parties and the measures that the employer intends to apply unilaterally are recorded in their final state.

However, these provisions do not apply to the modification of company savings plans set up at the initiative of the company before the date of publication of law no. 2004-804 of 9 August 2004 to support consumption and investment.

Lorsque l’entreprise compte au moins un délégué syndical ou est dotée d’un comité social et économique, le plan d’épargne d’entreprise est négocié dans les conditions prévues à l’article L. 3322-6. Si, au terme de la négociation, aucun accord n’a été conclu, un procès-verbal de désaccord est établi dans lequel sont consignées en leur dernier état les propositions respectives des parties et les mesures que l’employeur entend appliquer unilatéralement.

Toutefois, ces dispositions ne sont pas applicables à la modification des plans d’épargne d’entreprise mis en place à l’initiative de l’entreprise avant la date de publication de la loi n° 2004-804 du 9 août 2004 pour le soutien à la consommation et à l’investissement.
