Article L3341-1 of the French Public procurement code

For the application of the legislative provisions of Book I in Saint-Pierre-et-Miquelon:
1° In article L. 3112-3, the word “other” is deleted;
2° In article L. 3114-9, the words “within the meaning of Commission Recommendation 2003/361/EC of 6 May 2003 concerning the definition of micro, small and medium-sized enterprises” are deleted;
3° In article L. 3123-1, the references to articles 1741 to 1743, 1746 and 1747 of the General Tax Code are replaced by references to locally applicable provisions having the same purpose and the words: “as well as for equivalent offences under the legislation of another Member State of the European Union” are deleted;
4° In article L. 3123-21, the words: “outside the territory of the European Union” are replaced by the words: “in a third country”;
5° The first paragraph of Article L. 3124-6 reads as follows:
“Defence or security concessions are awarded to economic operators from Member States of the European Union. “
6° Article L. 3126-3 is deleted;

6° bis In the first paragraph of Article L. 3133-1, the word “transmit” is replaced by the words “may transmit”;
7° Article L. 3134-3 is deleted;
8° Article L. 3136-5 is deleted.

Article L3341-1

Pour l’application des dispositions législatives du livre Ier à Saint-Pierre-et-Miquelon :
1° A l’article L. 3112-3, le mot : ” autres ” est supprimé ;
2° A l’article L. 3114-9, les mots : ” au sens de la recommandation 2003/361/ CE de la Commission du 6 mai 2003 concernant la définition des micro, petites et moyennes entreprises ” sont supprimés ;
3° A l’article L. 3123-1, les références aux articles 1741 à 1743,1746 et 1747 du code général des impôts sont remplacées par les références aux dispositions ayant le même objet applicables localement et les mots : ” ainsi que pour les infractions équivalentes prévues par la législation d’un autre Etat membre de l’Union européenne ” sont supprimés ;
4° A l’article L. 3123-21, les mots : ” hors du territoire de l’Union européenne ” sont remplacés par les mots : ” dans un Etat tiers ” ;
5° Le premier alinéa de l’article L. 3124-6 est ainsi rédigé :
” Les concessions de défense ou de sécurité sont passées avec des opérateurs économiques d’Etats membres de l’Union européenne. ” ;
6° L’article L. 3126-3 est supprimé ;

6° bis Au premier alinéa de l’article L. 3133-1, le mot : “ transmettent ” est remplacé par les mots : “ peuvent transmettre ” ;
7° L’article L. 3134-3 est supprimé ;
8° L’article L. 3136-5 est supprimé.
