Article L3342-1 of the French Public procurement code

For the application of the provisions of Book II to Saint-Pierre-et-Miquelon:
1° The second paragraph of Article L. 3200-1 is deleted;
2° 1° of Article L. 3212-1 is worded as follows:
“1° A legal instrument such as an international agreement relating to works or services intended for the joint implementation or operation of a project by its signatories;”;
3° In Article L. 3212-4 :
a) In 4°, the words: “or to operations carried out with the European Financial Stability Facility or the European Stability Mechanism” are deleted;
b) In 9°, the words: “published in the Official Journal of the European Union” are replaced by the words: “defined in the Official Journal of the French Republic”;
4° In Article L. 3213-1, the words: “, provided that this provision is compatible with the Treaty on the Functioning of the European Union” are deleted;
5° In Article L. 3214-1, the words: “, provided that this provision is compatible with the Treaty on the Functioning of the European Union and the legal acts of the Union establishing common rules on market access applicable to the activities of network operators” are deleted;
6° Article L. 3214-2 is deleted;
7° In Article L. 3215-1:
a) In 4°, the words: “or an administrative arrangement relating to the stationing of troops or concluded between at least one Member State of the European Union and at least one third country” are deleted;
b) 5° is deleted;
c) In 6°, the words: “outside the territory of the European Union” are replaced by the words: “outside the territory of Saint-Pierre-et-Miquelon”.

Article L3342-1

Pour l’application des dispositions du livre II à Saint-Pierre-et-Miquelon :
1° Le second alinéa de l’article L. 3200-1 est supprimé ;
2° Le 1° de l’article L. 3212-1 est ainsi rédigé :
” 1° Un instrument juridique tel qu’un accord international portant sur des travaux, ou des services destinés à la réalisation ou à l’exploitation en commun d’un projet par ses signataires ; ” ;
3° A l’article L. 3212-4 :
a) Au 4°, les mots : ” ou à des opérations menées avec le Fonds européen de stabilité financière ou le Mécanisme européen de stabilité ” sont supprimés ;
b) Au 9°, les mots : ” publiées au Journal officiel de l’Union européenne ” sont remplacés par les mots : ” définies au Journal officiel de la République française ” ;
4° A l’article L. 3213-1, les mots : “, à condition que cette disposition soit compatible avec le Traité sur le fonctionnement de l’Union européenne ” sont supprimés ;
5° A l’article L. 3214-1, les mots : “, à condition que cette disposition soit compatible avec le Traité sur le fonctionnement de l’Union européenne et les actes juridiques de l’Union établissant des règles communes concernant l’accès au marché applicables aux activités d’opérateur de réseau ” sont supprimés ;
6° L’article L. 3214-2 est supprimé ;
7° A l’article L. 3215-1 :
a) Au 4°, les mots : ” ou un arrangement administratif, relatif au stationnement de troupes ou conclu entre au moins un Etat membre de l’Union européenne et au moins un Etat tiers ” sont supprimés ;
b) Le 5° est supprimé ;
c) Au 6°, les mots : ” hors du territoire de l’Union européenne ” sont remplacés par les mots : ” hors du territoire de Saint-Pierre-et-Miquelon “.
