Article L3371-2 of the French Public procurement code

For the application of the legislative provisions of Book I in New Caledonia :

1° In Article L. 3112-3, the word “other” is deleted ;

2° In Article L. 3113-1, the words: “mentioned in Article L. 5213-13 of the Labour Code” and “mentioned in Article L. 344-2 of the Social Action and Family Code and equivalent structures” are replaced by the words: “created in application of local regulations”;

3° In Article L. 3113-2, the words: “mentioned in Article L. 5132-4 of the Labour Code and equivalent structures” are replaced by the words: “created in application of local regulations”;

4° In Article L. 3114-9, the words “within the meaning of Commission Recommendation 2003/361/EC of 6 May 2003 concerning the definition of micro, small and medium-sized enterprises” are deleted;

5° In Article L. 3123-1, the references to Articles 1741 to 1743, 1746 and 1747 of the General Tax Code are replaced by references to locally applicable provisions having the same purpose and the words: “as well as for equivalent offences under the legislation of another Member State of the European Union” are deleted;

6° In Article L. 3123-3, the references to Articles L. 640-1, L. 653-1 to L. 653-8 and L. 631-1 of the French Commercial Code are replaced by references to provisions having the same purpose and applicable locally;

7° In Article L. 3123-4, the words: “breaches of the obligations laid down in Articles L. 1146-1, L. 8221-1, L. 8221-3, L. 8221-5, L. 8231-1, L. 8241-1, L. 8251-1 and L. 8251-2 of the Labour Code” are replaced by the words: “having committed an offence in terms of concealed work, illegal employment of foreign nationals and bargaining as defined by locally applicable legislation” and the references to 2° of Article L. 2242-1 of the Labour Code are replaced by the reference to the locally applicable provisions having the same purpose;

8° In Article L. 3123-5, the reference to Article L. 8272-4 of the Labour Code is replaced by a reference to the provisions having the same purpose and applicable locally;

9° In Article L. 3123-21, the words: “outside the territory of the European Union” are replaced by the words: “in a third country”;

10° The first paragraph of Article L. 3124-6 reads as follows:

“Defence or security concessions are awarded to economic operators from Member States of the European Union. ” ;

10° bis In Article L. 3133-1, the words “the State, local authorities and public establishments” are replaced by the words “the State and its public establishments” and the word “transmit” is replaced by the words “may transmit”;

10° ter In Article L. 3133-2 and 1° of Article L. 3133-6, the words “the State, local authorities and public bodies” are replaced by the words “the State and its public bodies”.

11° In Article L. 3133-11, the words: “in Article L. 441-6 of the French Commercial Code” are replaced by the words: “by locally applicable regulations”;

12° In Article L. 3136-4, references to the French Commercial Code are replaced by references to locally applicable provisions having the same purpose;

13° In Article L. 3137-3, the words “as provided for in Article 2044 of the Civil Code” are deleted;

14° In article L. 3137-4, the words: “As provided for in the first paragraph of article 2060 of the Civil Code,” are deleted.

Article L3371-2

Pour l’application des dispositions législatives du livre Ier en Nouvelle-Calédonie :

1° A l’article L. 3112-3, le mot : ” autres ” est supprimé ;

2° A l’article L. 3113-1, les mots : ” mentionnées à l’article L. 5213-13 du code du travail ” et ” mentionnés à l’article L. 344-2 du code de l’action sociale et des familles et ainsi qu’à des structures équivalentes ” sont remplacés par les mots : ” créées en application de la réglementation locale ” ;

3° A l’article L. 3113-2, les mots : ” mentionnées à l’article L. 5132-4 du code du travail et à des structures équivalentes ” sont remplacés par les mots : ” créées en application de la réglementation locale ” ;

4° A l’article L. 3114-9, les mots : ” au sens de la recommandation 2003/361/ CE de la Commission du 6 mai 2003 concernant la définition des micro, petites et moyennes entreprises ” sont supprimés ;

5° A l’article L. 3123-1, les références aux articles 1741 à 1743,1746 et 1747 du code général des impôts sont remplacées par les références aux dispositions ayant le même objet applicables localement et les mots : ” ainsi que pour les infractions équivalentes prévues par la législation d’un autre Etat membre de l’Union européenne ” sont supprimés ;

6° A l’article L. 3123-3, les références aux articles L. 640-1, L. 653-1 à L. 653-8 et L. 631-1 du code de commerce sont remplacées par les références aux dispositions ayant le même objet applicables localement ;

7° A l’article L. 3123-4, les mots : ” méconnaissances des obligations prévues aux articles L. 1146-1, L. 8221-1, L. 8221-3, L. 8221-5, L. 8231-1, L. 8241-1, L. 8251-1 et L. 8251-2 du code du travail ” sont remplacés par les mots : ” avoir commis une infraction en matière de travail dissimulé, d’emploi illégal d’étranger et de marchandage définies par la législation localement applicable ” et les références au 2° de l’article L. 2242-1 du code du travail sont remplacées par la référence aux dispositions ayant le même objet applicable localement ;

8° A l’article L. 3123-5, la référence à l’article L. 8272-4 du code du travail est remplacée par la référence aux dispositions ayant le même objet applicable localement ;

9° A l’article L. 3123-21, les mots : ” hors du territoire de l’Union européenne ” sont remplacés par les mots : ” dans un Etat tiers ” ;

10° Le premier alinéa de l’article L. 3124-6 est ainsi rédigé :

” Les concessions de défense ou de sécurité sont passées avec des opérateurs économiques d’Etats membres de l’Union européenne. ” ;

10° bis A l’article L. 3133-1, les mots : “ l’Etat, les collectivités territoriales et les établissements publics ” sont remplacés par les mots : “ l’Etat et ses établissements publics ” et le mot : “ transmettent ” est remplacé par les mots : “ peuvent transmettre ” ;

10° ter A l’article L. 3133-2 et au 1° de l’article L. 3133-6, les mots : “ l’Etat, les collectivités territoriales et les établissements publics ” sont remplacés par les mots : “ l’Etat et ses établissements publics ”

11° A l’article L. 3133-11, les mots : ” à l’article L. 441-6 du code de commerce ” sont remplacés par les mots : ” par la réglementation applicable localement ” ;

12° A l’article L. 3136-4, les références au code de commerce sont remplacées par les références aux dispositions ayant le même objet applicables localement ;

13° A l’article L. 3137-3, les mots : ” ainsi que le prévoit l’article 2044 du code civil ” sont supprimés ;

14° A l’article L. 3137-4, les mots : ” Ainsi qu’en dispose le premier alinéa de l’article 2060 du code civil, ” sont supprimés.
