Article L3423-9 of the French Labour Code

When, as a result of a reduction in working hours below the contractual working hours for reasons other than those listed in 1° of Article L. 3423-8, an employee has received, over the course of a month, by way of salary and statutory or contractual allowances for partial deprivation of employment, a total sum lower than the minimum remuneration, he shall be allocated a supplementary allowance equal to the difference between the minimum remuneration and the sum he has actually received.

These provisions apply without prejudice to those set out in the second paragraph of Article L. 3232-5.

Article L3423-9

Lorsque, par suite d’une réduction de l’horaire de travail au-dessous de la durée contractuelle pour des causes autres que celles qui sont énumérées au 1° de l’article L. 3423-8, un salarié a perçu au cours d’un mois, à titre de salaire et d’allocations légales ou conventionnelles pour privation partielle d’emploi, une somme totale inférieure à la rémunération minimale, il lui est alloué une allocation complémentaire égale à la différence entre la rémunération minimale et la somme qu’il a effectivement perçue.

Ces dispositions s’appliquent sans préjudice de celles prévues au deuxième alinéa de l’article L. 3232-5.
