Any insurance undertaking whose head office is located within the territory of a Member State of the European Union may establish a branch within the territory of the French Republic which carries out the operations referred to in Article L. 310-1 for which it has received authorisation from the supervisory authorities of its home State, provided that the Autorité de contrôle prudentiel et de résolution has first received the required information from these authorities. An order of the Minister responsible for the economy sets out the terms and conditions for the application of this article, and in particular the conditions under which the company is informed by the Autorité de contrôle prudentiel et de résolution of the receipt of this information and the date on which it may commence business.
The undertakings referred to in the previous paragraph shall be represented on French territory by a general representative, whose obligations shall be determined by decree of the Conseil d’Etat.
