Article L382-3 of the French Insurance Code

I. – Where a supplementary occupational pension fund expressly renounces its authorisation by undertaking not to underwrite any new contracts, does not make use of its authorisation within one year of the date of publication in the Journal officiel of the authorisation decision or has ceased to carry on the activity corresponding to its authorisation for two consecutive financial years, it shall immediately inform the Autorité de contrôle prudentiel et de résolution. The Autorité shall immediately record that the authorisation has lapsed, and shall publish this fact in the Journal officiel.

In the event that the fund transfers its entire portfolio of contracts, the Autorité de contrôle prudentiel et de résolution shall immediately declare that its authorisation has lapsed, which shall be published in the Journal officiel.

II. – A supplementary occupational pension fund whose authorisation has lapsed remains subject to the supervision of the Autorité de contrôle prudentiel et de résolution until all the commitments arising from the contracts subscribed by the fund have been paid in full and definitively to the policyholders and third party beneficiaries or until its entire portfolio of contracts has been the subject of a transfer authorised under the conditions set out in Article L. 384-1.

Article L382-3

I. – Lorsqu’un fonds de retraite professionnelle supplémentaire renonce expressément à son agrément en s’engageant à ne plus souscrire de nouveaux contrats, ne fait pas usage de son agrément dans un délai d’un an à compter de la date de la publication au Journal officiel de la décision d’agrément ou a cessé d’exercer l’activité correspondant à son agrément pendant deux exercices consécutifs, il informe immédiatement l’Autorité de contrôle prudentiel et de résolution. L’Autorité constate sans délai la caducité de l’agrément, qui est publiée au Journal officiel.

En cas de transfert par le fonds de la totalité de son portefeuille de contrats, l’Autorité de contrôle prudentiel et de résolution constate sans délai la caducité de son agrément, qui est publiée au Journal officiel.

II. – Un fonds de retraite professionnelle supplémentaire dont la caducité de l’agrément a été constatée reste soumis au contrôle de l’Autorité de contrôle prudentiel et de résolution jusqu’à ce que l’ensemble des engagements résultant des contrats souscrits par le fonds ait été intégralement et définitivement réglé aux assurés et aux tiers bénéficiaires ou que la totalité de son portefeuille de contrats ait fait l’objet d’un transfert autorisé dans les conditions prévues à l’article L. 384-1.
